Terms and Conditions

These Terms & Conditions must be accepted as part of all proposals contracts issued by Locum X LTD, company number 12555627, registered office: Lynton House, 7-12 Tavistock Square, London, England, WC1H 9BQ

In these Terms and Conditions, the following definitions apply:

  • "LocumX" refers to LocumX Limited, the company providing locum placement services.

  • "Client" means the person, firm, or organisation to whom LocumX provides services.

  • "Locum" means the individual introduced by LocumX to provide services to the Client.

Terms of Business

1. Contract Formation

1.1. These Terms constitute a contract between LocumX and the Client for the supply of Locum services.

1.2. These Terms contain the entire agreement between the parties and prevail over any other terms put forward by the Client.

1.3. No variation to these Terms shall be valid unless agreed in writing by a Director of LocumX.

2. Client Obligations

2.1. The Client is responsible for supervising the Locum and ensuring satisfaction with their work.

2.2. The Client must provide a safe working environment and comply with all relevant health and safety regulations.

2.3. The Client shall notify LocumX immediately if a Locum fails to attend work or is deemed unsuitable for the Assignment.

3. LocumX Obligations

3.1. LocumX will make reasonable efforts to ensure the suitability of Locums and provide information about their qualifications and experience.

3.2. LocumX will conduct all required background checks and verify the Locum's right to work in the country.

4. Liability

4.1. LocumX shall not be liable for any loss, expense, or damage arising from any failure to provide Locums or from the negligence, dishonesty, or misconduct of the Locum.

4.2. The Client shall indemnify LocumX against any costs or liabilities incurred as a result of the Client's breach of these Terms.

5. Termination

5.1. The Client may terminate an Assignment if unsatisfied with the Locum's performance provided that LocumX is notified in writing within 48 hours.

5.2. LocumX reserves the right to terminate an Assignment if it believes the Locum is unsuitable or if the Client breaches these Terms.

6. Confidentiality and Data Protection

6.1. Both parties agree to keep confidential all information obtained in relation to the other party and the Locum.

6.2. Both parties shall comply with all applicable data protection laws and regulations.

7. General

7.1. These Terms are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.

7.2. If any provision of these Terms is held to be invalid or unenforceable, it shall be deemed severed from the Terms and shall not affect the remaining provisions.

7.3 Governing Law

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
